In these Terms, “SVB Sports”, “we”, “our” and “us” refer to the business identified above.

After submission, you may receive an automated acknowledgement. This confirms that we received the order but does not necessarily mean that the order has been accepted.

An order is accepted when we:

• issue an express order confirmation;
• begin preparing a customised product;
• dispatch the goods; or
• otherwise expressly confirm acceptance.

For COD orders, acceptance may also depend on successful telephone, OTP, email or WhatsApp verification.

We may decline or cancel an order before acceptance where reasonably necessary, including because of:

• stock unavailability;
• an obvious pricing or description error;
• failed or incomplete payment;
• failed COD verification;
• suspected fraud or unauthorised activity;
• shipping restrictions;
• legal or regulatory restrictions;
• an incorrect or incomplete delivery address;
• inability to supply a customised request; or
• an event outside our reasonable control.

If we cancel a prepaid order before dispatch, we will refund the amount received for the cancelled item or order using an appropriate payment method.

Prices are displayed in the currency selected or supported by the website.

Unless otherwise stated, the final amount payable may include:

• product price;
• applicable Indian taxes;
• shipping charges;
• COD charges;
• customisation or preparation fees; and
• other charges clearly displayed before order submission.

For international orders, destination-country customs duties, VAT, import taxes, brokerage or clearance charges may be payable separately by the recipient unless expressly stated otherwise at checkout.

We may change prices at any time before an order is accepted.

A price change will not ordinarily affect an order already accepted, except where:

• the displayed price was clearly incorrect;
• a mandatory tax or legal charge changes;
• the customer changes the order; or
• the customer agrees to a revised amount.

Payments may be processed by authorised third-party payment providers.

You must use a payment method that you are authorised to use.

We do not ask customers to share PINs, passwords, OTPs or complete payment-card details through email, telephone, social media or WhatsApp.

We try to ensure that prices are accurate, but errors may occasionally occur.

If an obviously incorrect price is displayed, we may contact you before accepting or dispatching the order.

You may choose to:

• confirm the order at the correct price; or
• cancel the affected item or order.

If we cannot contact you, or you do not agree to the corrected price, we may cancel the affected item and refund any payment received for it.

We will not rely on this clause to make an arbitrary price change after accepting an order.

Promotions, discount codes, vouchers and special offers may be subject to additional conditions.

Unless otherwise stated:

• only one discount code may be used per order;
• codes cannot be exchanged for cash;
• codes may have minimum-order or product restrictions;
• selected brands or products may be excluded;
• codes may expire;
• discounts may not apply to shipping, COD or customs charges;
• codes must be entered before the order is submitted; and
• promotional benefits may be cancelled where misuse or fraud is reasonably suspected.

If an order is returned, the refund may reflect the actual discounted amount paid rather than the original listed price.

Where a promotion includes a free product, the free product may also need to be returned if the qualifying purchase is returned.

Cash on Delivery may be available for eligible orders and serviceable PIN codes within India.

COD availability may depend on:

• order value;
• destination PIN code;
• product category;
• package size;
• courier support;
• order history; and
• successful verification.

Additional COD charges may apply and will be displayed at checkout.

We may cancel or restrict COD orders where:

• verification is unsuccessful;
• the customer cannot be contacted;
• the order appears fraudulent;
• the delivery address is incomplete;
• previous COD orders were repeatedly refused or unclaimed; or
• the selected product is not eligible.

Repeated refusal or failure to receive COD orders may result in prepaid-only ordering for future purchases.

Shipping, dispatch, tracking, delivery estimates, customs, failed deliveries and damaged-shipment procedures are governed by our Shipping and Delivery Policy.

Processing and delivery periods are estimates unless we expressly guarantee a date.

Delivery may be affected by:

• courier serviceability;
• weather;
• public holidays;
• transport disruption;
• customs clearance;
• high order volumes;
• remote destinations;
• customer unavailability;
• incorrect address information; or
• circumstances outside our reasonable control.

Customers must provide complete and accurate shipping information and should monitor courier communications after dispatch.

We deliver to selected international destinations shown or supported at checkout.

The customer or recipient is responsible for:

• confirming that the product can lawfully be imported;
• providing documents required by customs;
• paying applicable customs duties, taxes and clearance charges;
• responding to courier or customs requests; and
• complying with destination-country requirements.

If an international shipment is refused, abandoned or returned because the recipient does not complete customs clearance or pay applicable import charges:

• original shipping charges may not be refundable;
• return freight may be deducted;
• customs or handling expenses may be deducted; and
• any remaining refund may be issued only after the parcel is returned and inspected.

International customers may also have mandatory consumer rights under the law applicable to them.

Where SVB Sports selects or arranges the delivery carrier, responsibility for loss of or damage to the goods generally remains with SVB Sports until the goods are delivered to:

• you;
• a person identified by you;
• an authorised recipient at the delivery address; or
• another delivery location expressly selected or approved by you.

Responsibility may pass earlier where you independently appoint a carrier that was not offered or arranged by SVB Sports, subject to applicable law.

After confirmed delivery, you are responsible for protecting the parcel and products.

Nothing in this clause affects rights relating to defective, incorrect, damaged or non-conforming goods.

A cancellation request should be submitted as soon as possible after placing the order.

We may be able to cancel an order before:

• dispatch;
• customisation begins;
• preparation services begin;
• a special-order product is sourced; or
• a personalised product enters production.

Cancellation cannot be guaranteed after processing has started.

Orders that have already been dispatched must generally be handled under the applicable Returns, Refunds and Cancellation Policy.

Customised, personalised, prepared, made-to-order and special-order products may not be cancellable after work begins, except where required by applicable law or where the product is defective or incorrectly supplied.

Any payment-gateway, preparation or other deduction must be lawful, reasonable and disclosed in the applicable policy.

Returns, exchanges, refunds, damaged-item claims and cancellation procedures are governed by our Returns, Refunds and Cancellation Policy.

The relevant policy should explain:

• eligible products;
• excluded products;
• reporting periods;
• required condition;
• supporting photographs or videos;
• return-shipping responsibility;
• inspection procedures;
• refund methods; and
• expected processing periods.

• oiling;
• protective-sheet application;

Preparation times and applicable charges should be displayed on the product page, service page, checkout or order confirmation.

Customers are responsible for reviewing and approving submitted customisation details.

After preparation begins, these products may not be cancellable or returnable for change of mind, except where:

• the product is defective;
• the customisation does not match the accepted instructions;
• the wrong product was supplied; or
• applicable law requires another remedy.

Products may be covered by:

• a manufacturer warranty;
• an SVB Sports warranty;
• a product-specific guarantee; or
• mandatory consumer rights.

Any applicable warranty conditions should be displayed with the product or provided separately.

Warranty coverage may depend on:

• the nature of the product;
• correct use;
• proper maintenance;
• proof of purchase;
• inspection; and
• compliance with the warranty conditions.

A warranty may not cover:

• ordinary wear and tear;
• accidental damage;
• misuse;
• improper storage;
• unauthorised repair or alteration;

• damage caused by use outside the product’s intended purpose.

However, no warranty exclusion removes any statutory remedy that cannot lawfully be excluded.

The Consumer Protection Act contains specific product-liability provisions concerning manufacturers, service providers and product sellers.

Do not share:

• OTPs;
• PINs;
• passwords;
• complete card details; or
• online-banking credentials

with anyone claiming to represent SVB Sports.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

Subject to that qualification, SVB Sports will not be responsible for losses that:

• were not reasonably foreseeable when the relevant contract was formed;
• result from the customer’s misuse of a product;
• result from inaccurate information supplied by the customer;
• arise from unauthorised alteration or repair;
• arise from an event outside our reasonable control; or
• are business losses suffered by a consumer acting wholly for personal purposes.

For business customers, and to the fullest extent permitted by law, we are not responsible for:

• loss of profit;
• loss of revenue;
• loss of business opportunity;
• loss of goodwill; or
• indirect or consequential commercial loss.

Any limitation of financial liability should remain subject to:

• mandatory consumer rights;
• product-liability law;
• fraud or fraudulent misrepresentation;
• wilful misconduct;
• personal injury or death caused by negligence; and
• any liability that cannot legally be limited.

To the extent permitted by law, a person using the website for business purposes agrees to compensate SVB Sports for reasonable losses, liabilities and expenses arising directly from:

• infringement of another person’s intellectual-property rights;
• fraudulent activity;

• courier network disruption.

Where such an event materially affects an accepted order, we will make reasonable efforts to:

• inform the customer;
• provide a revised estimate;
• offer an available alternative; or
• cancel and refund the affected item where appropriate.

We may suspend, restrict or terminate access to an account or the website where reasonably necessary because of:

• fraud;
• security risk;
• unlawful conduct;
• misuse;
• repeated violation of these Terms;
• abuse of staff or service providers;
• unauthorised automated activity; or
• legal requirements.

Suspension of website access does not remove obligations arising from an accepted order or any mandatory customer rights.

These Terms are governed by the laws of India, subject to any mandatory protections available to a customer under applicable law.

However, nothing in this clause prevents a consumer from approaching a court, consumer commission, regulator or dispute-resolution body that has mandatory jurisdiction under applicable law.

• business practices;
• payment or delivery arrangements;
• legal requirements; or
• security needs.

The revised Terms will be published with an updated date.

Changes will generally apply from the date of publication and will not retrospectively alter an order already accepted unless:

Entire agreement

Severability

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply.

No waiver

A delay or failure to enforce a right does not automatically waive that right.

Assignment

You may not transfer your rights or obligations under an order without our consent.

We may transfer our rights or obligations as part of a genuine business restructuring, provided this does not reduce mandatory customer protections.

Headings

Headings are included for convenience and do not alter the meaning of these Terms.

Language
